2. Scope

These terms and conditions apply to all orders, commissions and services offered by Makary Sobolewski via this website.

3. Offers and contract

Presentations of artworks on this website do not constitute a binding offer. A contract is concluded only after written confirmation of the order.

4. Prices and payment

All prices are in Euro and include VAT where applicable. Payment terms are agreed individually for each commission.

5. Delivery

Shipping costs and delivery times are agreed individually. Risk of loss passes to the buyer upon handover to the carrier.

6. Right of withdrawal

Consumers within the European Union have a 14-day right of withdrawal for distance contracts. The withdrawal period begins on the day the consumer, or a third party designated by them, takes possession of the goods. To exercise the right of withdrawal it is sufficient to send a clear declaration by email to makarysobolewski@gmail.com. Pursuant to § 312g(2) no. 1 BGB the right of withdrawal does not apply to artworks made to the customer's individual specifications or clearly tailored to their personal needs. Before a contract is concluded, consumers receive the full statutory withdrawal instructions together with the model withdrawal form in writing.

7. Copyright

All artworks, images and texts on this website are protected by copyright. Any use beyond private viewing requires written permission.

8. Commissions

Commissioned works are created in close coordination with the client. Sketches and drafts remain the intellectual property of the artist until final payment. Changes after written approval may incur additional costs.

9. Warranty and liability

Statutory warranty rights apply. Liability for slight negligence is limited to breach of essential contractual obligations and foreseeable, typical damage.

10. Applicable law

German law applies. Place of jurisdiction is Berlin, as far as legally permitted.
